Personal Injury Specialists

When dealing with an injury, the injured person or persons often turn to a legal professional in order to get some advice or assistance. However, simply choosing a solicitor from the personals or the internet would be similar to picking a financial advisor the same way; it would be a risky action. When someone injures another in the U.K., it is not necessary to prove that there was an intention to injure the victim. However, there is the necessity to prove that the defendant was negligent in some way. This kind of negligence could mean that the responsible party either did something to cause the injuring of the claimant, or they failed to do something that could have prevented the injury. Since this requires a degree of expertise and knowledge regarding what kinds of actions constitute compensatory negligence, an injuries specialist should be selected who can personalise the details of the damages claim according to the particulars of each special case.

A number of solicitors claim to be injuries specialists, but the personal specialist that you choose should have experience in the type of injury claim that you are pursuing. For example, you wouldn't want to choose a solicitor or law firm who are personal specialists in medical malpractice if you are dealing with a criminal negligence claim. That would be akin to calling a paediatrician to attend to your ailing grandmother. If you need a reference to a reputable solicitor, the local Citizen Advice Bureaux, located through out Great Britain, are a good source of information. So are the Community Legal Service Direct office and its various Law Centres throughout the United Kingdom.

However, there is another agency that specialises in connecting the public with qualified injury specialists. The Personal Injury Panel is managed by the Law Society. It provides a list of solicitors throughout the U.K. who have met the requirements to become recognised members of the panel. In order to become a panel member, a solicitor must pass an application and screening process. He or she must specialise and have at least 3 years of experience in arguing injury claims, must have represented at least 36 injury cases in the preceding 36 months, and must provide the Law Society with a significant amount of detail regarding their overall experience and operating procedures. Once a solicitor is accepted to the panel, he is required to abide by the standards of professional practice set forth by the panel and to continue to develop himself professionally by means of certain required developmental and training activities.

Many of these specialists will provide a free half hour legal consultation to people who are considering taking legal action for their accident case. Taking advantage of this resource can help an individual decide if their claim is strong enough or is likely to earn enough to risk the costs and stresses associated with pursuing legal action. They can also learn about what is involved in the process and what steps they will need to take. The list of members is available from the Law Society at www.lawsociety.org.uk, is organised by region and is updated regularly. - Written 24/09/04*
