Ms Dugard and her family are accusing the California Department of Corrections of failing to effectively monitor Phillip Garrido, prolonging her time in captivity.
Ms Dugard was abducted on her way to a bus stop in 1991 at the age of 11 and was held captive for 18 years.
Phillip Garrido and his wife, Nancy, have been charged with kidnap and rape.
The charges relate to accusations against them of keeping Ms Dugard in a secret prison in their garden.
She had two children while in captivity.
Garrido was a registered sex offender and as such he was not allowed to be around children. However, corrections department officials never questioned the presence of Ms Dugard’s two children at his home.
