Compensation for Man Attacked With Stick

Blackburn magistrates have ordered Clitheroe resident Stuart Woodward to pay £100 in compensation to a man he assaulted with a stick.

The court heard that Woodward, 32, was waiting inside the Low Moor Club with the stick held above his head after he was earlier attacked by a group of youths.

He swung the stick at the first person to enter, who was actually an innocent man.

Woodward was convicted of the assault of Christopher Hayton, who hit as he was returning the club with his girlfriend. At the sentencing hearing, Woodward was ordered to compensate Mr Hayton with £100 and was also given a 12-month community supervision order.

Mr Don Green, prosecuting, said Mr Hayton had gone outside with his girlfriend where there was a verbal altercation with three teenagers.

As they made their way back inside, Mr Hayton was confronted by Woodward, and he was struck in the face with a piece of wood before his assailant was restrained by other club members.

Miss Clare Knight, defending, claimed that during an earlier incident her client had come under attack by a gang of youths.

She said: “He describes being jumped on and kicked and when he was interviewed by the police showed them a black eye and two missing teeth.

“He believed the person he hit was one of those who had assaulted him.”
