Victim of Traffic Accident Awarded €44,000

A woman from Malta was awarded damage of €44,000 after making a car accident claim for injuries suffered in a crash in July 2000.

The claim was launched by Josephine Micallef against two separate drivers, Rita Dimech and Tony Cutajar.

According to Ms Micallef, she was travelling along December 13 road when she was forced to slow to a stop because bad traffic. As she stopped, a vehcile driven by Ms Dimech smashed into the rear of her car and threw her forward against the windscreen.

A second collision occured just a few seconds later when a car, driven by Mr Cutajar, crashed into Ms Dimech’s car which was once again forced into Ms Micallef’s car. She was thrown forward into the windscreen for a second time.

Ms Micallef said the first impact was more forceful than the second one.

Mr Justice Joseph Azzopardi said he was satisfied that Ms Micallef’s evidence was truthful. He added that Ms Micallef had suffered a 12 per cent permanent disability and therefore she should receive €44,421.15 in compensation.

Ms Dimech was found to be 80% liable for the incident and must pay Ms Micallef €35,536.92. Mr Cutajar was ordered to pay €8,884.23.
