
The mother of a nine-year-old girl, who had to be delivered prematurely following a car accident caused by the girl’s father, is making a claim for compensation.
Karen Cook was 28 weeks pregnant at the time of the accident. She was a passenger in her fiancé David Cook’s car when they were involved in a crash in January 2001.

She was taken urgently to hospital, where her daughter Jamie-Rae was born prematurely via an emergency Caesarean section. She required a tube to be inserted to divert fluid away from her brain.
However, according to a writ, three years later the tube became blocked and the child’s doctor, Elizabeth Walker of the Wallingford Medical Practice, failed to correctly diagnose the problem.
Due to the pressure on her brain because of the blockage, she completely lost her sight and suffered more brain damage.
Mrs Cook, from Cholsey, has named Mr Cook in the writ, saying his negligent driving was the cause of the accident, and Dr Walker for her medical negligence. Mr Cook was convicted of driving without due care and attention shortly after the crash.
Jamie-Rae’s injury solicitors are arguing that if the accident had never happened, neither would her subsequent premature birth and injuries.
