Pavement Still Not Repaired After Young Girl is Injured in Fall

After little Bailey Smart, aged five tripped, on a pavement and smashed her face, her angry father is demanding that repairs be carried out to correct the damage.

Bailey Smart was left semi-conscious following her fall in East Mayne, Basildon, near to the bridge which leads to Northlands Park.

Bailey, who is a pupil at Greensted Junior School, was taken to Basildon Hospital and given pain killers for a black eye and cuts to both her arms and legs.

Both parents Ashley, 45, and Maria, 30, are seeking compensation from Essex County Council, which is responsible for maintenance of pavements and roads.

Bailey’s father Ashley, who works at a local supermarket as a stock controller, was horrified when he returned to the same spot to discover the damage still not repaired – more than five weeks after Bailey’s accident, at 3pm on 20th August.

“She was talking to her brother Alfie when she caught her foot in this huge crack. She came down very hard on her face. It left her very shaken up. It was a dreadful experience for her.”

He said Bailey still has the scars from the accident, but she is now healing well.

He added: “What really concerns me is that they have taken no action to sort this out.

“It is quite bad damage to the pavement and the hospital said she was lucky not to have broken anything. I would hate to see what would happen to an elderly person if they had a fall there.”

Bailey’s parents have received a letter from the Council explaining that an investigation will be carried out before the compensation claim is assessed.

Essex County Council spokesman Michael Page said: “An engineer has been out to investigate the area and we have arranged for repairs to be carried out as soon as possible.”
