Tow truck driver’s family settles for $1.5m

The family of a tow truck driver who died in a 2008 road accident has settled a wrongful death lawsuit with a trucker and his employer for $1.5m (£963,000).

Marie Waite was claiming against the truck driver, Mark D. Boehm, and Double D Express for the accident that killed her son, 49-year-old William Waite in June 2008. Mr Waite died while he and Christian Henninger were assisting a broken down tractor-trailer. The pair were hit from behind by an eastbound semi driven by Boehm, according to the 2009 lawsuit.

Henninger survived the crash and filed a personal injury claim against both defendants which he settled.

Stephen D. Phillips, the family’s injury lawyer, said that they had chosen to settle rather than pursue a judgment that could have potentially seen Double D bankrupted, which would in turn have had a detrimental effect on the area’s unemployment.

He said that their unselfish decision had been made in spite of the fact that their own 49-year-old business had to cease trading after William’s death.
