Muslim Waitress Wins £3,000 for Sexual Harassment
Posted on Jun 30, 2009
A 33 year old Muslim cocktail waitress has been awarded £3,000 in compensation after quitting her job after refusing to wear a "sexually revealing and indecent" bright red dress for work.
The woman, Fata Lemes of North London, a Bosnian Muslim, won the £3,000 compensation award even though the Central London tribunal panel did not accept her claim that the red dress was "sexually revealing and indecent". The panel, however, did accept that Bosnian Muslims do have different views and standards over "modesty and decency" which British people may not fully understand, and accepted Miss Lemes view that the dress was "disgusting" and made her look "like a prostitute".
The panel were told that Miss Lemes left her job at Mayfair's Rocket Bar eight days after she had been told to wear the dress because she felt that in wearing the dress she "might as well be naked".
The panel rejected Miss Lemes' compensation claim for £20,000, calling it "absurd", and awarded her £2,919.95 for any hurt feelings she experienced and for loss of earnings. The panel commented that:
"Her perception was that wearing the dress would make her feel as if she was on show. That perception was legitimate."
