Cyclist Wins Nearly £6,000 in Accident Compensation

A cyclist in Scotland has been awarded £5,750 by a court in Edinburgh after he took the Scottish Government to court for injuries he sustained because of a dangerous drain.
42 year old insurance worker Iain Anderson was cycling along a cycle path in Holyrood Park, Edinburgh, in August 2005, when a sunken drain brought him off his bike.
The cycling accident left Mr Anderson with a fractured cheekbone, a sprained wrist and cuts and bruises. Mr Anderson still suffers with facial numbness and has difficulty chewing because of the facial injuries he sustained in the accident.
Mr Anderson took the government to court, suing for personal injury compensation, because the cycle path was maintained by Scottish Government Agency, Historic Scotland. Witnesses concurred that Mr Anderson had been cycling normally, not erratically, and that there had been no other obstacles on the cycle path.
Lord Bannatyne, the judge at court, ruled that the sunken drain, which was located at the end of a gully on the cycle path, was responsible for Mr Anderson's accident and awarded him £5,750 for his injuries.
