>> Symptoms of whiplash injuries don't normally appear right after an accident. It may be 12 hours or more before you actually begin to feel the effects and even then they are not normally at their worst on first appearing. It is fairly common for whip lash to display itself a good few days after trauma and the signs to look for are: pain and stiffness in your neck along with possible swelling which can restrict the full range of movement you would normally have. Headaches are also a common side effect of the stress on your neck. Other possible symptoms include pain in the lower back, pains or numbness, pins and needles in the arms or hands, muscle spasms, dizziness, tiredness, difficulty swallowing, blurred vision and ringing in the ears (tinnitus). Loss of memory is rare but has been reported.
>> Most cases of whiplash clear up after only a few days and if mild will not normally result in compensation. The maximum time you should really expect the worst of the pain to last is one month. It may take a few months for the pain to completely go but you will only be compensated for the times that the pain stops you from really acting as normal. Obviously loss of earnings from the pain will be taken into account. Beware of falling into the trap of simply agreeing with everything the solicitor or claims handler says to you, if they say "the pain lasted around two weeks or so, right?" they are feeding you information as anything less than two weeks is generally not considered severe enough to warrant a higher level of compensation. Although many people get away with exaggerating their injuries, if any discrepancies show between what your solicitor/claims handler has written and what your G.P. has written you can expect a whole host of problems. Despite that fact that this is common injury you can bet that yours will be the case the insurer decides to check on that day.
>> When you first speak to a solicitor about your whiplash compensation case they will normally make a quick calculation from their own experience as to how much the claim is "worth". If they believe they cannot get you more than the minimum legal amount (at the time of writing this is £1,000) then they will not represent you because their fees will not be paid by the courts and would normally swallow up all of your compensation. If they believe they can achieve more than £1,000 then they may take up your whiplash claim. If one solicitor does come back with a low figure don't be afraid to ask for a second opinion from another firm.*
